Terms and Conditions
1. Compliance With Laws and Regulations
The Merchant acknowledges and agrees that they are fully compliant with all applicable laws, regulations, and official directives in force within the United Arab Emirates, including those issued by the Ministry of Health and Prevention (MOHAP), municipal authorities, the Department of Health, and any relevant regulatory bodies overseeing cosmetic, beauty, and therapeutic services. The Merchant further confirms that all services provided through the platform are delivered strictly within the scope of valid licenses, official permits, and legally approved operational frameworks.
2. Use of Authorized Materials
The Merchant undertakes to use only natural, cosmetic, or therapeutic materials that are officially approved by the competent authorities and that fully comply with the required quality and safety standards. The use of any unlicensed, unapproved, or unidentified materials is strictly prohibited, and the Merchant shall bear full legal responsibility for any harm, damage, or liability resulting from such use.
3. Prohibited Religious Materials
The Merchant shall refrain from using any products that contain materials prohibited under Islamic law, including but not limited to non-medical alcohol and pork-derived ingredients. The Merchant is solely responsible for verifying and ensuring the compliance of all product ingredients prior to use.
4. Prohibited Eyebrow Plucking (Namas) Services
The Merchant is strictly prohibited from providing or advertising eyebrow plucking (namas) services in any form, in adherence to Islamic regulations. Only services that are permissible under Islamic law—such as trimming, cutting, or medically licensed procedures when necessary—are allowed.
5. Medical and Laser Services
The Merchant undertakes not to provide any medical or therapeutic services, or any laser-based treatments that require medical supervision, unless they hold the appropriate official licenses issued by the competent authorities. The Merchant shall bear full legal responsibility for any service provided without the required authorization.
6. Health and Safety Standards
The Merchant shall adhere to the highest health and safety standards, including the proper sterilization of tools, the use of clean and hygienic materials, the maintenance of a safe and sanitary environment, and the proper disposal of used materials in accordance with approved procedures. The Platform reserves the right to request proof of compliance with these standards at any time.
7. Accuracy of Information and Content
The Merchant undertakes to provide accurate, truthful, and complete information regarding the services offered, the materials used, pricing, and expected results. The Merchant bears full responsibility for any error, misrepresentation, misleading information, or content that is inaccurate, incomplete, or in violation of any applicable rights.
8. Service Quality and Performance Standards
The Merchant bears full responsibility for the quality of all services provided to customers and for adhering to the service descriptions published on the Platform. Any deviation, damage, deficiency, or failure in performance shall be deemed solely the result of the Merchant's actions or omissions, and not attributable to the Platform in any manner.
9. Professional Conduct and Ethical Standards
The Merchant shall maintain a high level of professional conduct when dealing with customers and shall refrain from any unlawful, unethical, or inappropriate practices. The Merchant is strictly prohibited from requesting any additional payments outside the scope of the Platform.
10. Data Protection and Privacy
The Merchant shall comply with the UAE Personal Data Protection Law (PDPL) and maintain the confidentiality of all customer data, refraining from sharing, disclosing, or misusing such information in any manner. The Merchant bears full responsibility for any breach or violation of data privacy obligations.
11. Use of the Platform's Trademark
The Merchant agrees to use the Platform's logo, branding elements, and promotional materials solely for authorized purposes, including official stickers, QR codes, and approved brochures. Any unauthorized use, alteration, or misuse of the Platform's trademark or branding in any form is strictly prohibited.
12. Content, Advertising, and Images
The Merchant undertakes to ensure that all images, advertisements, and content published through the Platform are original, accurate, non-misleading, and fully aligned with community values and cultural standards. The Merchant is strictly prohibited from posting any content that is inappropriate, deceptive, unlawful, or infringes upon intellectual property rights.
13. Platform Disclaimer of Liability
It is expressly understood that the Platform's role is limited to acting as an intermediary that facilitates booking and payment processes, without any involvement in the nature of the service, its execution, or the materials used. The Platform shall bear no direct or indirect responsibility whatsoever for any services provided by the Merchant, nor for any damages, errors, professional negligence, religious or regulatory violations, health or legal breaches, claims, or compensation arising therefrom.
14. Merchant's Responsibility Before Government Authorities
The Merchant acknowledges that they are solely responsible before all government and regulatory bodies—such as the Department of Health, municipal authorities, the Ministry of Health and Prevention, and insurance entities—for any violations, fines, reports, or claims arising from their practices, services, or the actions of their staff. The Platform shall have no obligation or liability toward any governmental authority or affected parties in connection with any breach or misconduct committed by the Merchant.
15. Enforceability of Terms Upon Registration
The Merchant acknowledges that their registration on the Platform, access to the Merchant Dashboard, or use of any of the Platform's services constitutes full and explicit acceptance of all terms and conditions set forth herein, regardless of whether a separate written agreement has been executed. These terms shall be legally binding upon the Merchant immediately upon joining the Platform.
16. Monitoring and Suspension
The Platform reserves the right to suspend, restrict, or permanently deactivate the Merchant's account, with or without prior notice, in the event of any violation of these terms, any risk posed to customer safety, the provision of unlicensed services, or the use of prohibited materials. The Merchant shall have no right to claim any form of compensation or damages resulting from such suspension or deactivation.
17. Amendments and Updates
The Platform may amend or update these terms and conditions at any time to remain compliant with applicable local regulations. The Merchant's continued use of the Platform following any such amendments shall constitute explicit acceptance of the updated terms.
18. Governing Law and Dispute Resolution
These terms and conditions shall be governed by and construed in accordance with the laws and regulations of the United Arab Emirates. The courts of the Emirate of Abu Dhabi shall have exclusive jurisdiction over any dispute arising out of or relating to these terms, following an initial attempt at amicable settlement between the parties.
